Late charges; courts are increasingly taking a hard line when it comes to extensions of time for charges over the assets of debtors
Article Abstract:
Several cases indicate the courts are enforcing Australia's Corporations Law in respect to businesses' late filing of notice of required charges. In Campbell Finance vs Vivstan Packaging (Aust) Pty Ltd, a company lost loans because of late filing. Morris vs Woodings, a company had to file for bankruptcy following a late notice of charges. Accountants should be aware of the circumstances under which they may receive an extension of the charge filing time limit.
