Cable ruling may portend Internet curbs
Article Abstract:
The Supreme Court handed down a decision that overturns a 1992 law intended to deter 'indecent' material on cable television. The decision was lauded as a victory by both First Amendment advocates and conservatives. The court's main opinion was authored by Justice Stephen Breyer. In contrast with the resounding victory for First Amendment rights on the Internet set forth by a Philadelphia court in Jun 1996, Breyer's Jul 1, 1996, opinion emphasized great concern by the court that children be protected from accidental exposure to pornography on the Internet. Most at issue in the case were three provisions amended by arch-conservative Jesse Helms. One, which encourages cable operators to ban indecent programming, passed in a 7-2 vote. Another requiring operators to block indecent material on public access stations failed by a 5-4 margin. A third provision requiring written requests from subscribers wishing to access indecent material also failed by a vote of 6-3.

The planned memorial, the group maintains, would destroy the Mall by using up a 7.4 acre site between the Lincoln Memorial and the Washington Monument. The veterans group is calling for the preservation of this open space.
