In U.S. vs. Microsoft, Government has edge

The government has seized an early lead as its antitrust case against Microsoft enters its third week. Candid testimony from Netscape CEO James Barksdale, the first government witness, outlined how Microsoft's software market dominance merits regulation. Apple Senior Vice Pres Avadis Tevanian is scheduled to take the stand today and is expected to accuse Microsoft of blackmail, software sabotage, and an illegal market-division move in multimedia software. Legal observers also are criticizing Microsoft of changing its courtroom tactics at a time when the defense should present a clear and consistent message. Microsoft initially said a 1995 meeting between Microsoft and Netscape officials was fabricated, then insisted that Microsoft had been set up. The Justice Department and 20 states suing Microsoft hold that Microsoft intended to divide the Web browser market at the meeting. Microsoft also has experienced difficulty with Judge Thomas Penfield Jackson.

A strategy shift helps Microsoft score in court
Article Abstract:
As the end draws inevitably nigh, Microsoft and it's lawyers are shifting focus in order to produce a more fruitful solution. Instead of setting al hopes on winning the case, which now seems unlikely, Microsoft has instead put its energies into coming to some sort of settlement or modest penalties.
