Microsoft and U.S. seek to upset judge's decision

Microsoft and the US Dept of Justice (DOJ) filed appeals on Mar 7, 1995, seeking to reverse a ruling by federal court Judge Stanley Sporkin that rejected a previously negotiated antitrust settlement agreement between the software vendor and the DOJ. In their appeal, attorneys for Microsoft are also seeking to have Judge Sporkin removed from the case if it were to be remanded to the lower court. The company charges that the justice relied on information contained in the book 'Hard Drive' written by James Wallace and Jim Erickson in his views about Microsoft. The book contains information from interviews with former Microsoft employees and software competitors. The DOJ appeal charges that Judge Sporkin overstepped his authority in rejecting the settlement agreement. The US Court of Appeals is scheduled to hear oral arguments on the matter on Apr 27, 1995.

Microsoft remedy envisions curbing Windows system
Article Abstract:
The Justice Department and state's attorneys general are struggling with the complexity of issues regarding the limitation of Microsoft's monopoly power. Prosecutors are considering forcing the software giant to make public the secret, proprietary code for Windows so that other companies could sell competing operating systems. Officials are also considering breaking up Microsoft, which would still leave the problem that at least one of the baby software companies would still control the operating system. Another proposal would make Microsoft charge every computer maker the same price for Windows. Since Judge Thomas Penfield Jackson's decision last week, state prosecutors around the country have been enlightened to the extent of Microsoft's abuse of monopoly power. If the company is finally found guilty, it is a sure thing Microsoft will appeal.
