Microsoft suit pushed back until Oct. 19

Federal Judge Thomas Penfield Jackson has delayed the start of the Government's antitrust trial Microsoft to Oct 19, 1998. Jackson also ordered Microsoft to honor the Justice Department's request to conduct narrow searches of the company's financial records. The suit filed by the Justice Department and 20 states was scheduled to begin on Oct 15, 1998. Microsoft expressed concerns about opening its database for Government study, but Jackson ordered the records examination after receiving promises from Government attorneys of targeted searches. Both sides have added two witnesses, as Microsoft has accused the Government of attempting to widen its case at the last minute. The Government named former Apple Exec Avi Tevanian and Sun Microsystems Exec James Gosling on Oct 8, 1998. Microsoft today named senior Microsoft Exec and former Sun employee Robert Muglia as well as Exec Chris Engstrom.

Microsoft disputes Netscape meeting account

Netscape Communications Corp is painted by a Microsoft lawyer as a willing participant in a Jun 1995 meeting at which Netscape now says Microsoft made an illegal offer to divide the market for Web browsers. The accusation that such an offer was made has emerged as a central feature in the government's antitrust lawsuit against Microsoft. In his cross-examination of Netscape Pres and CEO James L. Barksdale, Microsoft lawyer John Warden proposed that the accusation resulted from anger aroused when Netscape executives learned that Microsoft planned to bundle its browser, Internet Explorer, with its Windows operating system. Barksdale strongly denies this. A memo from Microsoft executive Dan Rosen, who attended the meeting, was entered into evidence by the Justice Department. The memo seems to bolster the government's account.
