Controller superannuation tax strategies take advantage of a legal loophole that has not been amended, and many taxpayers will reap the benefits. For the 1998-1999 tax year, taxpayers will receive $1.5 billion in tax deductions. When Section 274 of the Income Tax Assessment Act was amended by Parliament, it unwittingly waived the 15% deductible contributions tax and surcharge. The anti-avoidance provision is designed to apply if the purpose for entering a transaction is to avoid tax.
