Americanising EU antitrust litigation
Article Abstract:
Because of its limited resources, the European Commission cannot effectively enforce the European Union antitrust rules, so it is attempting to modernize the competition rules to encourage more civil litigation. Current rules make civil litigation difficult, so the Commission is seeking to modernize the antirust regime such that all civil actions will come under the jurisdiction of the national court. The European Court of Justice in Luxembourg's action in the Crehan v. Courage case is discussed.

Issues are presented concerning the provisions of Competition Act of 1998 which became law in March 2000. The United Kingdom's government's policy of producing antitrust laws to match those of the US is discussed.
