First come, first served: western water rights
Article Abstract:
Wyoming rancher John McTiernan, who took over his neighbor's water rights, claims he has the right to keep it because it was not used for more than five years. Sam Scott, the neighbor, wants to subdivide his land into smaller ranches, and exercise his water rights to irrigate them. Wyoming's water rights system is based on priority: whoever is the first one to set up an irrigation will gain the number one water right. Wyoming law also states that those who do not use their water for five years may lose it. The decision is expected to favor McTiernan.
