The practice of arbitration is more popular than litigation in China. The country's Civil Procedure Law does not allow parties from submitting certain disputes to foreign courts. The law allows for a choice of arbitration venues when addressed in the joint venture or contract. China has passed legislation that would affect the New York Convention on the Enforcement of Arbitral Awards.

Struggle for independence
Article Abstract:
The China Securities Regulatory Commission (CSRC) is a regulator struggling to govern an immature market where government intervention prevails. The CSRC, which has regulated China's new security issues, reports directly to the State Council and is an instrument of the central government and the limits of CSRC's effectiveness are being challenged.
