SFA: the professional's verdict

Views are mixed towards the Standard Form of Agreement (SFA)/92, designed to better secure the appointment of architects. The publication has helped inform clients of the demands they can make on architects, according to Mark Klimt, partner at Fishburn Boxer, solicitors. However, the SFA/92 is hard to understand and too complicated, according to Paul Chamberlain, partner of Sassi Chamberlain Associates. The SFA/92 is easier to use than the old blue-book version, and is being used by owner-occupier customers, according to Don Hands, director of Rolfe Judd, architects.

Half fees awarded in first adjudication case

The use of a fast-track adjudication system has lead to the payment of fees totalling 5,700 pounds sterling to a UK London-based architect firm which had been sacked by clients for excessive costs. The case highlights the benefits of taking disputed work to adjudication, which often prevents costs from escalating. Adjudication offers a solution to a problem which does not have to be accepted by either side in a disputed case, although the final agreement is legally binding. The best way to avoid conflict is to maintain open communication lines.

The limits of professional liability
Article Abstract:
Laws designed to limit liability in architectural services are being given full consideration by judges in court. The latest liability limiting clause specified in law SFA/99 stipulates a pounds sterling limit on architectural services. An architect's liability limit of 250,000 pounds sterling was deemed to be reasonable by a British judge in a recent court case.
