S&N bid highlights UK competition confusion

The lack of clarity of the United Kingdom's competition laws has been highlighted by the proposed takeover of brewer Courage of the United Kingdom by brewer Scottish & Newcastle (S&N) for 425 million pounds sterling. S&N would have a brewing market share of around 30% and the acquisition is being investigated by the Office of Fair Trading. It may subsequently be examined by the Monopolies and Mergers Commission. City analysts complain the government's policy is unclear and impractical. Brewer Bass of the United Kingdom plans to seek more acquisitions if permitted under competition law.

BDI pushes for German change

German competition legislation should be harmonized with European anti-trust rules, according to the Bundesverband der Deutschen Industrie (BDI), German industry's federal association. German firms complain the rest of Europe operates more liberal anti-trust laws than Germany. German laws would have prevented the co-operation deal made between automobile manufacturers Ford and German company Volkswagen for producing vans in Portugal, claims the BDI. The acquisition of bus maker Kassbohrer of Germany by Mercedes would also have been prevented by the German cartel office, says BDI.

DTI brews controversy with stance on S&N
Article Abstract:
The UK Department of Trade and Industry's (DTI) announcement on the proposed acquisition of Courage by Scottish & Newcastle (S&N) indicates that consolidation in the brewing industry will be viewed in a more favourable light. The 425 million pounds sterling takeover has not been referred to the Monopolies and Mergers Commission, instead the DTI has requested that S&N honour certain enforceable undertakings. Rivals in the brewing industry are angered at the decision, which will create a company with at least a 25% share of the market.
