Several aspects of joint and several liability: Dorgal Holdings Pty Ltd v Buckley
Article Abstract:
Dorgal Holdings Pty Ltd v Buckley (1996) is a case decided by the New South Wales Supreme Court which reiterates the rule that the release of one of debtors jointly and severally liable operates to release all of the joint and several debtors. At issue is whether the release of Davis operates to release Buckley and Scotton who were jointly and severally liable with the former. The High Court ruled that Scotton and Buckley, being joint and several debtors with Davis, were released from their obligations at the same time that Davis was released.
