The regulation of collective investments: the role and responsibilities of a trustee
Article Abstract:
The restructure of collective investments has been proposed whereby one single entity will replace the current two-tier system of manager and trustee. Trustees of a public unit trust scheme have the dual roles of being a safe repository of the trust fund and supervision of the manager's operation of the fund. Those who oppose the proposal point out that reposing the two functions in one entity will prove to be detrimental since their respective duties require that the trustee and the manager be independent of each other.
