Unfair advertising: liability for punitive damages
Article Abstract:
The violation of the trademark law by using the photographs made the Leatherman Tool Group to file a case against Cooper Industries. Initially the Ninth Circuit U.S. court approved the compensatory damages award of $50,000 and a punitive damages award of $4,500,000.

The federal rulings regarding trademark protections against a store in U.S. are presented. This suit was ruled out according to the federal trademark law and Trademark Act of 1946, the Lanham Act.
