Making limitation fair: The Law Commission has been examining how long contractors, specialists and consultants should be liable for defects in building projects
Article Abstract:
The Law Commission has received comments on its Limitation of Actions document. The Limitation Act 1980 had become complex due to the different liability regimes, and the Law Commission felt there should be a fundamental reform of the law on imitation of actions. The Law Commission's recommendations are not as onerous as those in the Working Group 10 document, and clients and the industry will have to invest in suitable latent defects and maintenance insurance policies.
