North Sails sued again by Sobstad

Sobstad Corp is again suing North Sails Group over the latter's Marathon 3DL sail, a fiber-reinforced sail geared for cruisers. The lawsuit accuses North Sails of infringing on Sobstad's patents, the subject of an earlier case involving both companies, and in which Sobstad won. North Sails has been ordered to pay Sobstad $5.4 million in damages and put in escrow all profits related to the 3DL sails. North Sail is contesting the decision, adding that the 3DL sail does not infringe on Sobstad's patents nor should it be made part of any agreement.

Judge finds for Sobstad; North Sails granted stay

Sobstad Sails has won its patent dispute case against North Sails when a federal judge ruled that North Sails must stop production of its 3DL sails and pay Sobstad a royalty fee of 7% on all 3DL sails that have been produced. 3DL sails are North Sails' flagship product used in the America's Cup and other competitive sailracers. North Sails received a patent on the 3DL product in 1992 but US District Court Judge Domenic Squarito that North Sail's patent on the 3DL product infringed upon Sobstad's patents which were granted earlier.

Judge awards $5.4M to sailmaker Sobstad
Article Abstract:
A federal judge has awarded $5.4 million to sailmaker Sobstad Corp as compensation in an eight-year patent infringement suit involving the company and rival North Sails. North has appealed the decision, which might be heard by the Circuit Court of Appeals in 2001 or 2002. Sobstad officals estimate that the total monetary award, including the original judgement and the subsequent earnings, will ultimately surpass $7 million.
