Article Abstract:
A number of cases heard in the UK courts have been challenging the role of the adjudicator in adjudications for the construction industry. Adjudicators should have the ability to make a decision on the existence of a contract and whether a dispute existed. There has been a disagreement between the judges over whether adjudicators have the right to award costs. There is concern small firms will no longer use adjudication if costs may be awarded against them in a dispute.

Article Abstract:
Following an incorrect decision made by an adjudicator between a main contractor Bouygues UK Limited and subcontractor Dahl-Jensen UK Limited, the judge in the case could not change the mistake. The adjudicator made an incorrect calculation when considering counter claims on a building contract and erroneously charged the one party too much. A senior Scottish judge pointed out decisions which were obviously flawed could be discarded. English and Welsh judges were less willing to challenge decisions made by adjudicators unless they went to court.
