Takings, compensation and endangered species protection on private lands
Article Abstract:
Conservation of endangered species found on private land raises potential conflicts with private economic activity and property rights. The debate over how the prospective costs of endangered species protection on private property should be imposed, for instance, centers on two different interpretations of takings. Section 9 of the Endangered Species Act of 1973 prohibits private citizens from taking any endangered species on their property while the Fifth Amendment states that no private property shall be taken for public use without just compensation.
