The introduction of Section 54A of Town and Country Planning Act 1990 has meant that development plans have become the most contentious issue in planning disputes. All planning applications must now be determined in line with development plan policies, but development plans can be legally challenged if councils have not meticulously complied with laid down procedures. The interpretation of development plans by developers, planners and DoE inspectors is also an issue.

Article Abstract:
It is suggested that plans to subject planning departments to compulsory competitive tendering (CCT) could have serious legal implications. As planning departments are decision makers aswell as service providers, the issue of contracting out becomes more complicated. Although planning departments have to date escaped CCT, they have been affected by the implementation of outside services.
