Article Abstract:
The decision by the UK Court of Appeal in the case of Thai Trading v Taylor (1998) may have put an end to any hope of an anticipated reduction in litigation arising from the abolition of Legal Aid for most civil money claims. The court's decision supported the use of conditional fee arrangements and encouraged new approaches to funding cases. Contingency and conditional fee agreements are now lawful and enforceable, and this has boosted the ability of claimants to sue. However, this does not mean that litigation is without risk, as plaintiffs are still liable for a range of costs if they lose their case.
