Miranda on the hot seat
Article Abstract:
The so-called Miranda Rights stemmed from a 1966 ruling by the US Supreme Court that made arresting officers responsible for advising those under arrest of their rights not to incriminate themselves. Unbeknownst to most people, the ruling was 'overruled' in 1968 by Congress in theory, though Congress has no power to overrule the Supreme Court's interpretation of the Constitution. In February of 1999, the case was reexamined, and a Supreme Court panel determined that the Miranda rule was in fact never a Constitutional requirement.
