A Public Health Approach to Reducing Error: Medical Malpractice as a Barrier
Article Abstract:
Medical malpractice laws could make it very difficult to improve the safety of medical care. The National Academy of Sciences made headlines in 1999 when it reported that between 44,000 and 98,000 Americans are killed each year by medical errors. The airline industry and the automotive industry have made substantial progress in reducing death by designing safer vehicles and learning from their mistakes. Many doctors are afraid to report their mistakes for fear of malpractice litigation. Some legal reforms will be necessary to allow doctors to create a confidential error reporting system.
