Aetna challenges Texas law lifting HMOs' ERISA shield
Article Abstract:
Aetna Health Plans of Texas and others have filed suit to block legislation in Texas that allows managed care plans to become defendants in medical malpractice suits. Aetna is arguing that employee benefit plans are exempt from state laws under the Employee Retirement Income Security Act. The Texas law allowing liability for health maintenance organizations and managed care plans was passed in June 1997 and takes effect in Sep 1997.
