Insist on objective standards for contract termination clauses
Article Abstract:
Associate physicians should make sure their employment contracts use objective standards to determine if they are terminated. Failure to include appropriate contract language means that such physicians could be terminated at the discretion of the practice. One of the ways physicians can prevent discretionary termination is to require professional misconduct be judged against the state's Medical Practice Act.

Assignment of contractual rights - and responsibilities
Article Abstract:
Physicians involved in business deals such as mergers may need to insert an "anti-assignment" clause into their contracts. This clause will prevent improper assignment of responsibility for professional services. The anti-assignment clause should not contain exceptions for affiliated parties, unless the physician consents.
