National Health Information Privacy: Regulations Under the Health Insurance Portability and Accountability Act
Article Abstract:
The Department of Health and Human Services has issued a final rule providing nationwide health information privacy protection under the Health Insurance Portability and Accountability Act of 1996. The rules will not pre-empt state laws if the state law provides greater protection.

The public health information infrastructure: a national review of the law on health information privacy
Article Abstract:
Laws covering the disclosure of individual health information need to be reformed. Many states have laws protecting individual health information to differing degrees, but many are not strong enough. Individuals should know what is known about them in government and private databases and they should know why it was collected. Information should be confidential with severe penalties for security violations. Informed consent should be required to release any information for purposes incompatible with the original intent for which it was collected.

Legal Issues Concerning Electronic Health Information: Privacy, Quality, and Liability
Article Abstract:
Laws are needed to protect the privacy of electronic health information. Electronic health information includes patients' medical records and this could lead to violations of privacy and lawsuits. Health information about an individual should be considered extremely sensitive information and should not be revealed to anyone without that person's consent. Many of the necessary protections should be implemented at the national level. Doctors can also assist in developing secure information networks.
