Article Abstract:
The Cooperative Compliance Program (CCP) of the Occupational Safety and Health Administration (OSHA) was struck down by a federal court because the CCP was considered a standard that did not comply with rules on making standards. Despite the decision, the court made it clear that OSHA has a great deal of discretion, especially when the agency is targeting a system. Specifically, OSHA's Site Specific Targeting Program would use specific site-specific data to inspect selected workplaces. A thorough examination of the rulemaking process was recommended by the court to OSHA.

OSHA standard stuck in neutral
Article Abstract:
It took the Occupational Safety and Health Administration (OSHA) some time before it began to act on a National Safety Council request for the creation of a motor-vehicle standard to minimize work-related vehicular accidents. As the proposed standard neared publication, however, the National Federation of Independent Businesses successfully convinced Congress to adopt an appropriation rider barring OSHA from pursuing its implementation. This prompted concerned groups to turn to the Senate, which promptly voted against the rider.

Article Abstract:
Questions raised by the Office of Management and Budget (OMB) regarding the Occupational Safety and Health Administration's (OSHA) permissible exposure limits rule bear serious implications. In emphasizing the effect of compliance costs on wages, employment and consumer expenses, OMB effectively asserts that health depends on the affluence of people and not on safety professionals, OSHA regulations and preventive measures.
