Clamping down on managed care; consumer distress fuels continued oversight
Article Abstract:
State legislatures passed numerous laws governing the healthcare industry as consumers vented their concern about health insurance programs. A law was passed in Texas that allows health maintenance organizations to be sued by their patients for negligence. Additional legislation was passed governing comprehensive patient protections as consumers express concern about managed care.

New anti-kickback 'safe harbors' now finalized
Article Abstract:
The federal government and health industry officials have worked out exceptions to the referral overutilization law that will provide safe harbors to specific entities. Entities that receive capitated federal payments would be exempt, as would those that bill Medicare on a fee-for-service arrangement. Private fee-for-service would not be exempt.
