Memoirs of an ERISA maven: the first 25 years are the hardest
Article Abstract:
The impact of the Employee Retirement Income Security Act (ERISA) on health benefit plans was evaluated. Specifically, ERISA's influence on health plan operations was looked into, starting from the enactment of ERISA in 1974 up to 1999. Health care continuation rules enacted under the Consolidated Omnibus Reconciliation Act of 1985 became the defining event of ERISA regulation in the 1980s. In the 1990s, the following measures were proposed or submitted. These include the Enactment of the Americans with Disabilities Act, Medicare restructuring and medical savings accounts.

Insurance commissioners have the added and major challenge of handling managed networks, for one. Factors affecting public choice, public control and innovation in the US health insurance market is found to be dependent on the ability of various stakeholders to interact with each other. Their positions on issues and their free market approach create an environment that fosters innovation and self-regulation even if regulators feel compelled to over-regulate the market.
