Access to justice, trade union rights, and the Indian Industrial Disputes Act, 1947
Article Abstract:
The Indian Industrial Disputes Act, 1947 necessitates that for a particular labor grievance to be heard by a court or a tribunal, governmental approval that the matter can be adjudicated is required. It is argued through an examination of the different justifications for this requirement that the Act requires to be amended so that the rights of workers and trade unions are brought in line with those enjoyed by other individuals in India.
