Alternatives to arbitration: are unions ready for change?
Article Abstract:
External mediation as a supplement to arbitration offers a faster and more cost-efficient means of resolving labor disputes than just arbitration. A neutral person from outside the company helps both employer and union develop a mutually acceptable solution. A survey of unions belonging to the Chicago Federation of Labor to see if the preference was for mediation, fact finding or arbitration of labor disputes found that respondents who use the first two do so in addition to arbitration. There was a dearth of information about mediation.

Does our arbitration have a place in the world of ADR?
Article Abstract:
Various organizations instrumental in developing due process protections for industrial arbitration including the ABA's Labor and Employment Law Section, the American Arbitration Ass'n, the Federal Mediation and Conciliation Service the ACLU and the National Employment Lawyers Ass'n established a Due Process Task Force. This task force developed a standard for due process protection in industrial arbitation. Reasons widespread adoption of the standard will improve industrial dispute resolution are listed.
