Software patent protection is growing, and while obtaining such patents has grown easier, then struggle to define statutory subject matter continues in many cases. Thus, the selection of a patent attorney for software patent applications should depend on the attorney's experience in drafting software patent applications and knowledge of software patents. Prudent software patent lawyers are drafting patent specifications that attempt both to avoid the undesirable claim scope limitations and to disclose and claim unequivocally the practical applications of underlying processes.

Article Abstract:
The US Court of Appeals for the Federal Circuit's various decisions regarding Patent Code section 112(6) show the importance of drafting patent claims clearly regarding invocation of the means-plus-function clause. By drafting both a claim to invoke the clause and a claim not invoking it, it is possible to demonstrate which is intended. A claim not to invoke the clause should describe claim elements in broad terms and avoid describing functions.

The Georgia Computer Systems Protection Act goes into effect on July 1, 1996 and is the first state law to criminalize the use of certain Internet e-mail addresses, Web pages and domain names.
