Bar's ad rules pass obstacle; plaintiffs lose burden of proof argument before Florida judge
Article Abstract:
A Florida federal judge has ruled that attorneys may not use techniques such as dramatizations and multiple voices in their television advertising unless they can prove these are never misleading. This decision upheld Florida rules that prohibit such ads unless the bar prescreens them and a disclaimer saying advertising is not the best way to select a lawyer is attached. The Florida bar felt the restrictions were necessary in order to stop the predatory, tasteless ads which were coming out, while plaintiffs charged that the rules violated their rights to freedom of speech and client development.

Lawyers feel bar's sting; investigators go undercover to probe crash solicitation
Article Abstract:
Texas authorities have come down hard on lawyer solicitation after an accident with an undercover operation to record attorneys' conversations after the May 11, 1996, Valujet crash and having an investigator pretend to be the family member of a crash victim. The names of three Texas lawyers have come to light in connection with this investigation, although confidentiality rules forbid stating whether any attorneys have been disciplined as a result. The ethical aspects of such an operation have been questioned.

Texas makes solicitation a felony; lawyers who target clients by direct mail plan court challenge to new law
Article Abstract:
Texas has enacted the strictest anti-barratry law in the country, making direct solicitation a misdemeanor the first time it happens and a third-degree felony punishable by 10 years in jail and a $10,000 fine after that. In deference to a state bar desire for time to develop their own rules, the law did not include regulations for attorney advertising. Solicitation is a crime in only six other states, all of which consider it a misdemeanor. All state bars have ethical rules barring direct solicitation.
