Breaking the deadlock
Article Abstract:
The move of the UK Government to focus resources on ADR indicates that it might not be long before the correct and inevitable conclusion is drawn by policy-maters that the nation requires mandatory systems of court attached ADR in civil cases. However, entrenched opposition by some senior and influential judges means that it is extremely difficult to argue with any prospect of success that ADR would need to be mandatory, as the Government is not quite at the point where it accepts the need for mandatory references.
