Broken promises may bust budget; S&L's high court victory in 'Winstar' is cited by others to demand billions
Article Abstract:
Plaintiffs who have nothing to do with the savings and loan industry are using the 1996 Supreme Court ruling U.S. v. Winstar Corp. to hold the federal government to its promises. One example is the housing industry, where cases raised in the Federal Circuit base holding the Department of Housing and Urban Development to promises regarding financing of low-income rental housing on that case. The potential damages of the government in all of these cases may be huge but are much less than Winstar's possible impact in electricity deregulation.
