Cigarette makers claim gain in court; state judge says A.G. can't bring common law claims
Article Abstract:
State judge Irene C. Berger of West Virginia on May 3, 1995, threw out 8 of 10 counts in a suit brought by the state attorney general (AG) to recover Medicaid expenses from tobacco companies. The judge harshly criticized the AG, who she said had, while on the state supreme court, written an opinion expressly denying the AG common-law authority. Many other states have similar limits, said a tobacco litigation consultant. Two counts concerning antitrust and consumer charges remain, as the judge says they are in the AG's authority.

No privilege for tobacco: Florida special master: papers come under crime-fraud exception
Article Abstract:
A Florida special master has ruled in Florida v. American Tobacco that more than 27,000 confidential tobacco company documents were covered by the crime-fraud exception to the attorney-client and work-product privileges. Anti-tobacco and plaintiffs' lawyers hail the ruling as a victory for their side and look forward to documents the Liggett Group Inc. is negotiating to hand over in partial exchange for releasing the company from liability.

New tobacco class actions gearing up; attorneys hold strategy meet on 'Castano' setback
Article Abstract:
Plaintiffs' tobacco lawyers are preparing state class actions against the industry, with discovery in progress in New York and California and trial dates already set in Pennsylvania and Florida. Some of these attorneys are considering a national class action against makers of smokeless tobacco. The industry feels that these cases will be thrown out and should be resolved with individual lawsuits.
