Civil rights vs. civil liberties? The legality of state court lawsuits under the Fair Housing Act
Article Abstract:
The 1968 Fair Housing Act covers state court lawsuits used for discrimination, and thus a balance must be found between the right to sue and civil rights to be free of housing discrimination. State court lawsuits can be used to intimidate and exclude particular groups of people from home ownership in a neighborhood, and this constitutes discrimination.
