Article Abstract:
The limitations on a plaintiff attorney's class communications by the impact of class litigation on a corporate defendant's public perception and by the tension with Federal Rule of Civil Procedure 23(a)(4)'s requirement for adequate representation and the First Amendment's restriction against prior speech restraints is discussed.

Successful interlocutory appeals of class certification orders under Federal Rule of Civil Procedure are discussed. Appellate courts have provided considerable guidance for the application of Rule 23(f) appeals, and the US Court of Appeals for the 11th Circuit has the most detailed standards.
