Article Abstract:
The differences in opinion and style demonstrated by the justices of the Warren Court highlight the importance of personality and, by extension, the importance of judicial biography to assist scholars and citizens in understanding why certain judicial decisions were made. The Warren Court cannot simply be described in terms of individual rights and judicial activism because changes in society and not merely changes in theory lead to the groundbreaking decisions of the 1960s. The complexity of the individuals on the court demonstrates the challenges faced by judicial biographers.

The wonder of the Warren Court
Article Abstract:
The portrayal of the Warren Court as the paradigmatic expression of the potential strength of the judicial branch has become more important to legal scholars as the court has become less activist and less political. Law professors have been unwilling to achieve detachment from the Warren Court and the judicial activism debate, in part, because the present US Supreme Court does not play as prominent a role in national policy. Quality judicial biographies of Warren Court justices will not result until legal scholars are more detached from the Warren Court.

Members of the Warren Court in judicial biography
Article Abstract:
Debate on the goals of judicial biography and the themes of the Warren Court raise questions about the significance of judicial activism and judicial restraint to the court. Many lawyers educated after the Warren Court adopted the view that the restraint activism debate was a false issue because the Court was actually more results-oriented. The contrasts in work habits among the members of the Warren Court highlight the importance of biographies that extend beyond the opinions of the justices.
