Contract for nonbeneficial use: New Mexico water law is drowned out by contract
Article Abstract:
The NM Supreme Court in Trujillo v CS Cattle Co upheld a land deed requiring at least 20,000 acre ft of reservoir water to be maintained although it constituted 'nonbeneficial water use' and a violation of NM water law. The court used contract law in reaching its decision and since the deed conflicts with New Mexico law and public policy, the court's decision sets a precedent for enforcing an illegal contract.
