Article Abstract:
The US Court of Appeals for the 2d Circuit, in Matthew Bender & Co. v. West Publishing Co. in 1998, limited the extension of copyright protection to electronic compilations. A publisher of judicial case reports claimed copyright protection for its pagination against two CD-ROM manufacturers. However, the Court denied the claim. The Court's disregard for key differences between paper and CD-ROM databases may limit the ability of compilers to protect their work.

The author outlines a ruling by the US 8th Circuit Court of Appeals that the court's own rule, proscribing the use of unpublished decisions as precedent, was unconstitutional because it exceeded the power granted the federal courts under Article III of the Constitution.
