Court hears cable TV decency case
Article Abstract:
The US Supreme Court on Feb 21 heard arguments in Denver Area Educational Telecommunications Consortium v FCC, a First Amendment challenge that may have implications for pending litigation over Internet restrictions. The plaintiff challenges Sec 10 of the 1992 Cable Act, claiming the govt, not cable operators, is effectively making decisions that ban programs, so the First Amendment applies. The Telecommunications Act of 1996 similarly puts pressure on online providers to censor constitutionally protected material.

The US Supreme Court recently heard two cases involving business speech, one over employee lawsuits against employers and one on the intersection of the First and 21st amendments. Varity Corp v Howe may determine whether participants in an employee benefit plan governed by the Employee Retirement Income Security Act can sue employers for injuries sustained personally, rather than only injuries to the plan. 44 Liquormart v RI involves the limits to state power to regulate advertising prices for alcohol.

Court upholds clinic zones, hears religion case
Article Abstract:
The US Supreme Court issued many important decisions during the week of February 18, 1997, including a ruling in Schenck v. Pro-Choice Network of Western New York in favor of a fixed buffer zone surrounding abortion clinic entrances. The decision may imply more restrictions on domestic violence and under stalking and harassment laws. The court also heard oral arguments in a religious freedom case and a major class action dispute.
