Court sides with lawyer on expenses; Ninth Circuit says deductions are permissible in some contingency-fee cases

The 9th US Circuit Court of Appeals upheld lawyer James F. Boccardo's revised method of billing clients in contingency-fee cases to make litigation expenses deductible. In 1987 Boccardo lost a challenge to the IRS, which said billing for costs plus one-third of the remainder of a judgment made the costs into a loan. He now bills a flat 40%, regardless of expenses. The finding may set off a flurry of new challenges by contingency-fee lawyers. Boccardo, 83, heads a prominent San Jose, CA, personal-injury firm.

Did Business Week fold too easily? Its strategy to publish sealed documents proves unsettling to some media lawyers

Business Week's success in getting a prior restraint on publication lifted may have come at too high a cost, for both the magazine itself and the whole publishing industry. The confidential source for the story ended up getting disclosed, the magazine accused him of lying under oath, and the district court ruling could hurt journalists nationwide unless the 6th US District Court of Appeals overturns it. Court hearings into how Business Week got material that was under seal raise particular concern.

D.C. Circuit tensions flare up
Article Abstract:
District of Columbia Circuit Court Judge James L. Buckley has called for an investigation into the leaking of former colleague Clarence Thomas' opinion in a sexual harassment case. The leak occurred while Thomas was undergoing nomination hearings before the Senate. The opinion in Lamprecht v. Federal Communications Commission was issued Feb 19, 1992, several months after Thomas' ascension to the High Court. Buckley issued his call for an investigation in his concurring opinion.
