E-litigation; clicks and contracts
Article Abstract:
Electronic commerce seeks to bind consumers to their contracts with the click of a computer mouse. Rulings including Caspi v. The Microsoft Network and the Uniform Computer Information (UCITA) Transaction Act argue for such contracts. Other cases say that shrink-wrap licenses are also enforceable. Taking advantage of the UCITA and of Caspi requires following the industry standard of integrating contractual terms into Web sites used for commerce.

Article Abstract:
The article discusses the US Court of Appeals for the 2d Circuit's 1999 ruling in Tasini v. New York Times Co. on the copyright for compiled works. The key issue was whether the publishers' argument that the secondary digital uses were protected "revisions" of the original works, and the court found in favor of the freelancers, ruling that this was not the case.

Article Abstract:
Issues regarding the legal specialty of helping with the framing of Web site content are discussed, and may consist of helping the client make decisions on using hyperlinks to drive Internet traffic from other sites to the client's site. Relevant court rulings are discussed, and can be caused by nonconsenual framing.
