EPA's amnesty has become a mixed blessing; incentives to identify toxic chemicals have deluged the agency with reports
Article Abstract:
The EPA is overwhelmed by records it has received under a Toxic Substances Control Act amnesty program and has in the law's 21 years has limited the sale of only 9 toxic substances. One of the law's sticking points is the requirement that manufacturers report serious toxicological effects even if the chemical's effect on humans differs from the effect on animals and few humans will be exposed to high levels of the chemical. These decisions are for public health officials to make after receipt of the data, not manufacturers before they make the data public.

Public works go private; when government sells off its services, does public law still govern?
Article Abstract:
Privatization of new or existing public works is taking hold nationwide, and raising new questions about both legal principles and technicalities. Wheelabrator Technologies recently bought the first operating wastewater treatment facility ever sold, in Great Miami Valley, OH, yielding $1.1 million for the communities involved. Such transfers indicate the potential of extending the process, but liability issues, tax laws favoring public bonds, existing low-bid systems, regulatory definitions, and public anxiety complicate the task.
