Companies battle over oil royalties; posted-price formula is at risk; Chevron has settled
Article Abstract:
Plaintiffs in the Texas case of Engwall v. Amerada Hess are trying to upend the "posted price" method of figuring out oil royalties, maintaining it results in underpayments. If the plaintiffs prevail, Texas mineral-rights owners would get millions of dollars in back royalty payments from major oil companies. More important, such a win could force a transformation across the industry in the way future royalty payments are calculated.

5th Circuit curbs EEOC's time to probe companies; the Hearst Corp., seeking finality, hails the ruling as a victory for employers

The United States Court of Appeals for the 5th Circuit has placed a time limit on US Equal Employment Opportunity Commission investigations, ruling that they must stop once the charging party has a right-to-sue letter from the agency and has filed suit. Counsel for Hearst Corp, the employer charged in the case, praise the decision as putting some finality on investigations.
