Postmortem strategies to shift retirement plan assets to the spouse
Article Abstract:
A surviving spouse may be able to receive the assets of a decedent's retirement plan even if the spouse is not named as beneficiary. The Taxpayer Relief Act of 1997 permits the spouse to roll the benefits over into an individual retirement account and defer income taxes until the spouse reaches 70 and 1/2. Designating the spouse as beneficiary before death is the recommended course.
