Ethics experts vouch for Exxon; heavyweights say secret side deal was legitimate

Many important figures in the legal community gave opinions in the Exxon Corp's favor after Judge H. Russel Holland's June 11, 1996, ruling that a special settlement agreement between Exxon and seven members of the seafood processing industry violated public policy. The agreement was made without the jury's knowledge and stated that the processors waived their claim to certain punitive damages in return for settling with Exxon. Had Judge Holland approved the agreement, it would have decreased by millions of dollars the $5bil punitive damages verdict levied against Exxon.

Will fish sink Valdez verdict? Exxon alleges juror misconduct and intimidation
Article Abstract:
Exxon is challenging the $5 billion Exxon Valdez verdict with allegations of improper juror influence and intimidation following an article in the Anchorage Daily News on Jan 22, 1995. Jurors spoke with the judge and attorneys for Exxon and the plaintiffs at a June 13-14 hearing that did not appear on the court's docket. Hearing transcripts reveal dead fish sometimes appeared on some jurors' lawns during the trial, as well as other possibly improper gatherings and discussions hinting at undue influence.

Alaska appeals Valdez reversal
Article Abstract:
Alaska is appealing the reversal of Captain Joseph Hazelwood's conviction in the Exxon Valdez oil spill disaster. The Alaska Court of Appeals agreed with Hazelwood's lawyers that Hazelwood could not be guilty of causing the disaster since the Federal Water Pollution Control Act exempts from prosecution those who report oil spills. Alaska disagrees and maintains the spill would have been discovered without Hazelwood's report.
