Handling a guardian ad litem
Article Abstract:
Tips for handling a guardian ad litem in contentious child custody litigation are given. Clients should make sure of the role of the guardian ad litem and a judicial order enumerating this role will be helpful. Clients should also try to resolve matters between themselves before using the guardian.

Factors used in determining child support are discussed. Income, of course, comes first, but the inclusion of overtime wages, if it is consistent, bonuses, and a perk such as a car allowance are other factors.

The custody client is probably under stress and may need more time to understand the implications of legal advice, so the lawyer should reinforce what is said and often query new clients as to their perceptions about the legal advice which has been given. Lawyers with custody clients are also in a unique position to influence the parent's behavior by emphasizing its impact on the child's best interests. This should always be a consideration with legal advice to custody clients.
