Article Abstract:
Amendments to the Federal Rules of Civil Procedure which have already taken place in 2000 and promise a significant effect on discovery practice are discussed. These include Rule 5(d), which will affect the confidentiality of discovery materials, and Rule 26(a)(1), which lists eight categories of cases exempt from mandatory disclosure.

Issues are discussed regarding the amendments to the Federal Rules of Civil Procedureto take effect at the end of 2000. Under the new Rule 26(b)(1), discovery will be limited to matters relevant to a party's claim or defense. Discovery is permitted of matters reasonably likely to be admissible. Other amendments are also discussed.

Federal practice; civil RICO conspiracy
Article Abstract:
A large body of case law has grown up around each of the Racketeer Influenced and Corrupt Organization Act's (RICO) subsections, and 18 USC 1962(d) concerns the standing to sue. The principal standing question arising under this statutory section is whether a party has standing to sue for a RICO conspiracy if the injury-producing wrongful acts are not "predicate acts" under section 1961(1). The US Supreme Court granted certiorari on this issue on June 7, 1999.
