Green paper on 'Net names still leaves many questions unsettled
Article Abstract:
Reform proposals on Internet domain-name administration abound, and there is no consensus. The two main issues are how the constantly increasing domain names should be registered, and how disputes over their ownership should be resolved. The Jan 30, 1998 White House discussion draft "A Proposal to Improve Technical Management of Internet Names and Addresses" suggests a private, non-profit entity operate in conjunction with Network Solutions Inc, the current registrar, for a limited period. Europe fears US domination of the international Internet and fears the vague references to international participation in the non-profit corporation do not suffice.

The Internet ignore the bases of trademark law, the fact that trademarks are issued for a particular geographical area and for a particular good or service. The territorial nature of trademark law makes little sense in an era of Website advertising and electronic mail. The organizing of marks according to kinds of goods or services also makes little sense on the Internet. Although there is no international trademark or domain-name registry, there are proposals for one. In the US there are a group of generic, top-level domain names.

Article Abstract:
No court has yet held Internet gambling to be illegal, although the ones on point have evaded potentially controversial Internet jurisdictional issues by attacking a type of gambling long considered illegal in the US, interstate sports betting by telephone. These indictments may, however, herald increased legislative activity against online wagering, but enforcing anti-gambling laws against the hundreds of thousands of Internet gambling operations across the world will not be easy.
